Exploring the Role of AI in Legal Practices: Opportunities and Limitations
As a corporate lawyer representing a major European firm with a sizable workforce of 25,000, I have taken a keen interest in integrating Artificial Intelligence within our Legal department over the past several years. Through this journey, certain realizations on the capabilities and limitations of AI in the field of law have emerged, which I would like to share.
One area where generative AI shows potential is its ability to enhance the textual aspects of legal documents. It offers valuable support in activities such as proofreading, summarizing, stylistic adjustments, and translation of legal texts. However, despite these strengths, challenges remain.
AI can indeed assist in distilling case files and highlighting key points. Nevertheless, I’ve observed its tendency to make critical mistakes, such as overlooking crucial facts, misinterpreting details, or committing other anomalies that are significant in legal contexts. For example, attempting to arrange events chronologically often results in inaccuracies, with dates presented out of sequence.
In addressing substantive legal questions, AI struggles notably. Although performance may improve with the provision of relevant legal content, including prior legal advice or sources, it frequently falls short of expectations. A noteworthy concern is the AI’s tendency to fabricate case law, leading to unreliable outputs.
Initially, my expectations were optimistic that improvements would occur over time. However, my confidence has waned. The absence of an infallible legal knowledge base presents a significant hurdle. When legal issues delve into complexity, multiple interpretations and diverse case law require a lawyer’s expertise to navigate. Questions linger on what sources AI must tap into to capture this knowledge adequately. Furthermore, the AI’s ability to genuinely comprehend text is limited. The capability to discern the significance of particular facts within the context of a specific legal issue remains a struggle. Although it’s theoretically possible to set the context through detailed explanations, producing a truly comprehensive narrative demands substantial depth.
Additionally, current software offerings in the market appear to focus predominantly on contract analysis. This area presents minimal added value for my company since contract negotiation is neither time-consuming nor legally intricate. Our primary interest lies in exploring how AI can aid in generating legal advice or assessments more effectively.
